Petitioners seek regular bail in connection with Kowakol P.S. Case No. 275 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioners is that Police intercepted two motorcycles on which four persons were riding and upon seeing the Police party two of them fled away and Police arrested two persons, including the petitioner and recovered total quantity of 80 liters of illicit liquor from the said motorcycles.

No.72512 of 2019(2) dt.04-12-2019 2/2 Learned counsel for the petitioners submits that petitioners have got no criminal antecedent and have falsely been implicated in this case. Learned counsel further submits that the motorcycles from which illicit liquor has been recovered do not belong to the petitioners. Learned counsel further submits that petitioners are in jail since 07/09/2019. Having regard to the submissions made by the parties and taking into consideration the fact that petitioners have got no criminal antecedent and the motorcycles from where the illicit liquor has been recovered do not belong to the petitioners, I am inclined to enlarge the petitioners on regular bail. Accordingly, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge Cum Special Judge, Nawada in connection with Kauakol P.S. Case No. 275 of 2019.
