JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-07-2018 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Jhanjharpur P.S. Case No. 06 of 2018 corresponding to G.R. No. 19 of 2018 for the offence registered under Sections 413, 414, 401 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.01.2018. He submits that in absence case of theft no case of Section 414 of the Indian Penal Code is made out. He further submits that in the instant case the motorcycle was recovered not from the conscious possession of the petitioner but from open place. He further submits that there is no material to connect this petitioner with the commission of any theft. He also submits that the said motorcycle does not belong to the petitioner.

Case no. 06 of 2018 corresponding to G.R. No. 19 of 2018.
