The petitioners seek pre-arrest bail in connection with Nabinagar (Badem O.P.) P.S. Case No.32 of 2018 registered under Sections 379, 411 and 420 of the Indian Penal Code and Sections 4 and 40 of the Bihar Minor Mineral Concession Rule. It is submitted by the learned counsel for the petitioners that six other co-accused persons having identical allegation to that of the petitioners have been granted pre-arrest bail by orders passed by different Benches of this Court on 10.04.2018, 25.04.2018 and 11.04.2018 in Cr. Misc. Nos.16695 of 2018, Cr. Misc. No.18010 of 2018 and Cr. Misc. No.16783 of 2018. He has

Patna High Court Cr.Misc. No.35306 of 2018 (2) dt.29-06-2018 2/2 produced web copy of those orders for perusal of the Court. The submission made by the learned counsel for the petitioners has not been controverted by the learned Additional Public Prosecutor appearing for the State.

Considering the grant of pre-arrest bail to co-accused, Rajnish Singh Yadav, Chandal Singh, Vinod Yadav, Dinesh Kumar, Chandan Kumar Jaiswal and Rahun Kumar Sinha by the orders passed in Cr. Misc. Nos. 16695 of 2018, Cr. Misc. No.18010 of 2018 and Cr. Misc. No.16783 of 2018, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Aurangabad in connection with Nabinagar (Badem O.P.) P.S. Case No.32 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
