JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-06-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners seek pre-arrest bail in connection with Shakurabad P. S. Case No. 104 of 2013 registered under Sections 323, 379, 406 & 420/34 of the Indian Penal Code. It is submitted that a purely civil case of money claim has been given a colour of criminal offence. It is further submitted that the petitioners have got no criminal antecedent and there is no truth behind the allegation made in the complaint, which was referred to the police for investigation under Section 156(3) of the Cr. P.C.

No.35286 of 2018 (2) dt.28-06-2018 2/2 Considering the nature of allegation made in the F.I.R and submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Cum-Sub-Judge-1, Jehanabad, in Shakurabad P.S. Case No. 104 of 2013, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
