2. The petitioner seeks regular bail in a case registered for the offence under Sections 376 and Section 34 of the Indian Penal Code.

3. This is a case of misuse of bail.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 04.10.2023. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and

Patna High Court CR. MISC. No.1527 of 2024(2) dt.18-01-2024 2/2 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. District and Sessions Judge, Aurangabad/concerned Court below in connection with Sessions trial no. 123 of 1998 arising out of Aurangabad Town P.S. Case No. 346 of 1997.

6(1).The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
