JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Ramgarhwa P.S. Case No. 241 of 2017 for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act, 2016.

Learned counsel for the petitioners submits that petitioner no.1 is not named in the F.I.R. and the name of petitioner no.2 has been surfaced on the basis confessional statement of apprehended accused, namely, Jitendra Sah. He submits that the petitioners are in custody since 26.03.2018 and have remained in custody for more than three months. Learned

Patna High Court Cr.Misc. No.36244 of 2018 (2) dt.28-06-2018 2/2 counsel for the petitioners submits that now the investigation is complete and in that view of the matter there is no chance that the petitioners may influence the investigation.

Considering the fact that the investigation is now complete, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of 4th Additional Sessions Judge-cum-Excise Judge Excise, East Champaran, Motihari in connection with Ramgarhwa P.S. Case No. 241 of 2017.
