2. The accused-petitioner, named in the F.I.R., is apprehending his arrest in connection with Ladaniya P.S. Case No. 107 of 2025 registered for the offences punishable under Sections 318(4), 64 of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.').
3. As per FIR, knowing the relationship of informant with petitioner, she was ousted from her matrimonial home whereafter she started to live with this petitioner and when on 27.02.2025, the informant was in process to solemnize marriage with this petitioner, on pretext of purchasing the marriage related items, the petitioner left the informant

Learned counsel appearing on behalf of the petitioner submitted that informant is a married lady and when she was ousted from her matrimonial home, she started to live in live-in-relationship with this petitioner with whom she was already in love prior to her marriage. It is submitted that as the earlier marriage of the informant was legally subsisting with her husband, therefore, promise of marriage, as alleged to be done by this petitioner, is not legally sustainable. It is pointed out that factual aspect of this case is suggesting only extra-marital affairs of the informant with this petitioner being a major and married lady. Petitioner claimed to be a man of clean antecedent.
5. Learned A.P.P. for the State opposes the prayer of anticipatory bail of the petitioner.
6. In view of aforesaid factual submission and by taking note of the fact as the informant is a married lady of 22 years old who was ousted from her matrimonial home and thereafter started to live in live-in-relationship with this petitioner, where promise of marriage prima facie not appears

No.79872 of 2025(2) dt.19-11-2025 3/3 convincing, accordingly, above-named petitioner, in the event of his arrest/surrender within a period of four weeks from this order, is directed to be enlarged on bail on furnishing of bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani/concerned court in connection with Ladaniya P.S. Case No. 107 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
