====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 29-08-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Jokihat P.S. Case No. 290 of 2013 registered for the offences punishable under Sections 376(1), 323 and 504/34 of the Indian Penal Code.

Informant is the victim girl, who in her written complaint has alleged that about five months ago at about 1:00 P.M. when she had gone to field for cutting grass, petitioner caught hold her and committed rape on strength of knife and thereafter promise her to marry but later on when she and her parents went to the house of petitioner then petitioner and his parents refuse to marry her and demanded two lacs for marriage and abused them.

Patna High Court Cr.Misc. No.39006 of 2018(4) dt.29-08-2018 2/2 Informant has appeared in this case and filed an affidavit stating therein marriage of his daughter has been solemnized with petitioner and she residing in her Matrimonial House.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat No. 290 of 2013.
