JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 This application, for grant of anticipatory bail, arises out of Makhdumpur P.S. Case No. 267 of 2019, disclosing offences under Sections 147, 148, 149, 323, 341, 324, 307, 379, 504 and 506 of the Indian Penal Code.
Allegation against the petitioner is of assault to mother in law of the informant on her head by means of rod. Submission of learned counsel for the petitioner is that while the petitioner was constructing his house, informant came and protested stating that petitioner is constructing house on his land, on which, the occurrence has taken place and although, there is allegation of assault to mother in law of the informant, injury sustained by the assault of petitioner, was found simple in nature, which, the petitioner has mentioned on oath in para - 9 of the petition.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jehanabad, in connection with Makhdumpur P.S. Case No. 267 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
