This is an application for grant of anticipatory bail in connection with Sheikhpura PS case no. 189 of 2015 registered for the offences punishable under Sections 419, 420, 467, 468, 471, 379, 120(B)/34 of Indian Penal Code.

The allegation is regarding the police having received information that unknown miscreants were indulging in cheating persons by resorting to a lottery scheme in the name and style of "Chehra Pehchano Inam Pao" and when the police is stated to have reached at the alleged place of occurrence, the miscreants had fled away and accused person namely Kundan Kumar was arrested and one A.T.M. card and other articles were recovered and he disclosed the name of the petitioner to be one of his accomplice. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.71785 of 2019(3) dt.05-03-2020 2/2 that the petitioner is innocent, has been falsely implicated in the present case and is having clean antecedent. It is further submitted that the petitioner has never indulged in any lottery scheme and has been roped in the present case merely on the basis of the confessional statement of the co-accused person namely Kundan Kumar, hence petitioner has got no complicity in the matter. Having regard to the facts and circumstances of the case and considering submissions made by the learned counsel for the petitioner, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail.

Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the learned court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura in connection with Sheikhpura PS case no. 189 of 2015 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
