Heard learned counsel for the petitioners and learned APP for the State.
The petitioners are in custody in a case registered for the offence punishable under Section 392 of the Indian Penal
Patna High Court CR. MISC. No. 80584 of 2024(2) dt.07-02-2025 2/3 Code.
As per allegation in the FIR, it is case of snatching one mobile along with some cash at the gun point of the informant by the accused persons.
Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He next submits that nothing incriminating article has been recovered from the active or conscious possession of the petitioners and no identification parade has been conducted and during course of investigation no independent witness who has come forward to support the prosecution version. He next submits that similarly situated co-accused has been granted bail by this Court passed in Cr. Misc. No. 56348 of 2024. Petitioners are in custody since 03.07.2024/04.08.2024 respectively.
Learned APP for the State opposes the prayer for regular bail of the petitioner.
In view of the aforesaid facts and circumstances of the case as well as the fact that similarly situated co-accused has been granted bail by this Court, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur, Ara in connection with
