ANJANA MISHRA ORAL ORDER 24-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the husband of the deceased lady, is in custody since 09.02.2018 in connection with Kesariya P.S. Case No.40 of 2018 registered for the offence under Section 304B of the Indian Penal Code, which is pending in the Court of 11th Additional Chief Judicial Magistrate, Motihari, East Champaran.

Post-mortem examination report also indicates that the cause of death is asphyxia as a result of pressure over neck. There is also history and allegation of demand of dowry. In view of the aforementioned facts and circumstances and because the petitioner being the husband

Patna High Court Cr.Misc. No.36625 of 2018 (5) dt.24-08-2018 2/2 has moral responsibility to take care of his wife, I am not inclined to grant regular bail to the petitioner. It is, accordingly, dismissed.
