Mr. Ashok Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-03-2020 The prayer for bail of the petitioner was earlier rejected vide order dated 24.09.2018 passed in Cr. Misc. No. 42945 of 2018.

The petitioner is said to be the author of the fatal injury on the daughter of the informant who is the deceased of this case.

Mr. Dr. Amrendra Kumar, learned advocate for the petitioner has submitted that there is pending land dispute and the possibility of false implication cannot be ruled out.

He further submits that the petitioner is in custody since 23.03.2018 and till date even charges have not been framed.

However, considering the nature of accusation against the petitioner, I am not inclined to grant bail to

Patna High Court CR. MISC. No.72368 of 2019(3) dt.05-03-2020 2/2 him for the present.

Accordingly, the prayer for bail is again rejected.

The trial court is directed to frame charges against the accused persons and proceed with the trial and conclude the same as expeditiously as possible preferably within a period of nine months from the date of receipt/production of a copy of this order, failing which the petitioner will have the liberty to approach the trial court for grant of bail, provided the delay in the conclusion of trial is not attributable to the petitioner in any manner.
