JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Agamkuan P.S. Case No. 267 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The petitioner is in custody since 16.04.2018. He submits that the petitioner was coming from Hajipur to Patna, as a passenger in the Tempo. He submits that the petitioner was arrested only on the basis of suspicion.

Considering the fact that the petitioner has remained in custody for more than two months and he has no criminal antecedent, the petitioner, named above, is directed to be released
