The petitioners are apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 448, 379, 427, 504 of the IPC. It is evident from the FIR that the occurrence had taken place because of a trivial controversy over a physical assault of the informant's grand-son, aged 10 years. It transpires that some scuffle had taken place and thereafter, it is alleged that

Patna High Court CR. MISC. No.73643 of 2019(2) dt.21-11-2019 2/2 the persons, named in the FIR including these petitioners, not only assaulted the informant but also took away some cash. Learned counsel for the petitioners submits that allegation against these petitioners is general and omnibus. Learned counsel for the petitioners further submits that coaccused has been granted bail by a co-ordinate Bench vide order dated 19.08.2019 in Cr. Misc. No.51479.

In the facts and circumstances of the case, let the petitioners, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Ist Class, Gaya in connection with Wazirganj P.S. Case No.100/2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
