JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Sadar P.S. Case No. 189 of 2018, dated 02.04.2018, instituted for the offences punishable under Sections 341, 447, 448, 323, 324, 354, 379, 504 and 506/34 of the Indian Penal Code. A quarrel had taken place between the sons of the informant and the petitioner and others. The aforesaid quarrel was settled by the intervention of the villagers. However, at that time, the petitioner had threatened that

Patna High Court Cr.Misc. No.35873 of 2018 (3) dt.20-07-2018 2/3 he shall avenge it later. On the day of the occurrence, the petitioner and others are alleged to have entered the house of the informant and assaulted her when they did not find her sons.

Learned counsel for the petitioner has submitted that prior to the present occurrence, the grandfather of the petitioner had lodged a case against the family members of the informant of the present case with respect to an occurrence which had taken place in a shop of the grandfather of the petitioner. This story is quite in tune with the allegation made in the present F.I.R. where the informant has admitted of there having occurred a quarrel between her sons and others.

The petitioner as well as the informant are agnates and the dispute appears to be over a minor issue. Regard being had to the aforesaid facts as also the clean antecedent of the petitioner, above named, he is directed to be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 189 of 2018,
