The petitioner seeks bail in connection with Barbigha P.S. Case No.280 of 2018, registered for the offence under Sections 341, 323, 354, 504, 506/34 of the Indian Penal Code and Section 37(c) of the Bihar Prohibition and Excise Act, 2016. It is submitted by learned counsel for the petitioner that a similarly circumstanced co-accused Ranjan Kumar and Sonu Kumar Jha have already been granted bail vide orders dated 28.02.2019 and 19.06.2019 passed in Cr.Misc.No.17337 of 2019 and Cr.Misc.No.39904 of 2019 respectively by different Benches of this Court. He contended that the petitioner is in custody since 18.10.2019 and has got no criminal antecedent. Having got roots in the society he is not likely to abscond or

Learned counsel for the State has opposed the prayer for bail to the petitioner. However, he does not dispute the fact that two co-accused, having identical allegation as against the petitioner, have already been granted bail by different Benches of this Court.

Considering the facts and circumstances, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II, Sheikhpura in connection with Barbigha P.S. Case No.280 of 2018, corresponding to Excise Case No.219 of 2018.
