2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 354(D), 292, 385, 504, 506 of the Indian Penal Code.
3. The case of the prosecution is that on 13.05.2024, he was watching Facebook on his mobile and suddenly, he saw that his villager Ram Krishn Kumar @ Piyush Kumar (the petitioner) has posted obscene photos of the family members of the informant with obscene words from his facebook ID, due to which the informant was embarrassed and hurt. After this, the informant made complaint on mobile resulting the petitioner
Patna High Court CR. MISC. No.82721 of 2024(3) dt.17-03-2025 2/3 started abusing by filthy language. It is also alleged that the petitioner demanded Rangdari of Rupees two lacs from his mobile number and threatening of dire consequences.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that the real fact is that the mobile number of the petitioner was hacked by someone and was used by someone. It is also stated that when the petitioner arrived from Delhi, he was arrested. His mobile was also recovered by the police but nothing was found on his mobile. It is also submitted that there is previous enmity between the parties. The Complaint Case and FIR have been lodged by the family members of the petitioner against the informant and his family members due to this, he has been falsely implicated. During investigation, I.O. has collected certain photographs which were handed over to him by the informant. It is further submitted that the allegation of Section 354B is there and for that offence the maximum punishment is three years. Moreover, the petitioner is languishing in judicial custody since 06.08.2024.
5. Learned APP appearing for the state and learned counsel for the informant have opposed the prayer of regular
Patna High Court CR. MISC. No.82721 of 2024(3) dt.17-03-2025 3/3 bail and submits that the petitioner is having criminal antecedent of two cases. It is also submitted that the photographs which have been produced by the informant were only from the I.D. of the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sahebpur Kamal P.S. Case No. 141 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Begusarai.
