2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Bihta P.S. Case No. 998 of 2024 registered for the offence under Sections 25(1b)a, 26 and 35 of the Arms Act.

3. Earlier the bail application of the petitioner has been rejected vide order dated 12.05.2025 passed in Cr. Misc. No. 18198 of 2025, which reads as under:

"Heard learned counsel for the petitioner and learned APP for the State Shri Jharkhandi Upadhyay.

2. The petitioner seeks regular bail in connection with Hathua P.S. Case No. 998 of 2024 registered for the offence under Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, the petitioner has been caught with illegal arms and two co-accused have also been caught

4. From the FIR, it appears that the petitioner is a member of a gang being led by Manik Singh. The petitioner is in custody since 27.10.2024.

5. Considering the aforesaid facts, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this application is dismissed.

7. The Senior Superintendent of Police, Patna is directed to examine the records of the case and he will decide that whether Section 111 of the BNS is applicable in the facts of the case or not. If the Senior Superintendent of Police, Patna finds that Section 111 of the BNS is applicable in this case, he will direct the I.O. of the case to act accordingly.

8. Let a copy of this order be communicated to the Senior Superintendent of Police, Patna through FAX for its compliance."

4. Learned Senior Counsel for the petitioner submits that the trial has started.

5. Considering the gravity of the offence and the fact that the trial has started, I am not inclined to review my earlier order.
