The petitioners seek regular bail in connection with Parbatta P.S.Case No.303 of 2019 dated 6.8.2019 registered for offences punishable under Sections 363, 366/34 of the Indian Penal Code.

FIR discloses that the sister-in-law (Nanad of the informant) was kidnapped by enticing away by Awadhesh Singh and she was recovered by the Police and further allegation is that on 26.7.2019, Awadhesh Singh, petitioners and other accused persons came and kidnapped his sister-in-law and she is still traceless.

Submission of the learned counsel for the petitioners is that in earlier case statement of his sister-in-law was recorded, in which she has not disclosed any allegation against the petitioners but again with similar allegation, petitioners have

So far petitioner no.1 is concerned, she is aged about 85 years and the petitioner no.2 has a minor son in her lap. They are ready to abide by any condition imposed upon them and they are in custody since 25.9.2019.

Heard learned A.P.P. as well as the learned counsel for the informant. They have opposed the prayer for bail on the ground that the informant is eye witness who has supported the allegation..

Having heard both sides and in view of the facts and circumstances, as stated above, and considering the age of the petitioner no.1 and the petitioner no.2 has a minor child in her lap, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Khagaria in connection with Parbatta P.S.Case No.303 of 2019.

With the above direction, this application is allowed.
