2. The petitioner is in custody in connection with Khizersarai P.S. Case No. 381 of 2017 for the offence punishable under sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code lodged on 30.12.2017 by the informant, Upendra Yadav.

3. As per the FIR, the informant alleged that the accused persons armed variously came to his private land and started constructing Bamboo hut. When this was objected, all the named accused assaulted which led to the injury which followed the FIR.

4. Learned counsel for the petitioner submits that he had no knowledge about the present case as a layman,

5. Learned APP opposes the prayer for bail and pointed out that not only he has four criminal antecedents, the fact remains that he was named in the FIR lodged in the year 2017 but came into judicial custody seven years later, thus, seriously hampering the trial.

6. There is force in the submissions of learned APP and a perusal of the FIR shows that he was a named accused despite that, he evaded his arrest for seven years and has criminal antecedents also.

7. In that background, this Court is not inclined to extend him relief for the present.
