Petitioners are in custody in connection with Kalyanpur P.S. Case No. 77 of 2018 for the offence under sections 272, 273, 414 of the Indian Penal Code and Section 30(a), 47 of the Bihar Wine Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that in the instant case the petitioners are rotting in jail since 20.5.2018. Learned counsel submits that in the instant case petitioner no.2 has no criminal antecedent whereas petitioner no.1 is accused in one case in which he was on bail. Considering the totality of facts situation and the

No.37579 of 2018(2) dt.28-06-2018 2/2 infirmity in preparation of seizure list and also the fact that petitioners are neither owner of the vehicle nor passengers of the vehicle nor driver of the vehicle, the court is inclined to grant bail to the petitioners, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VIth cum Special Judge, Excise, Samastipur, in connection with Kalyanpur P.S. Case No. 77 of 2018.
