The petitioner, in the present case, is seeking regular bail in connection with Kankarbagh P.S. Case No.163 of 2018, registered for offences alleged under Sections 326, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that a bare perusal of the FIR would show that according to the informant this petitioner had gone with the injured for purchasing of clothes and when both of them reached near Postal Park Chauraha two accused namely Shankar and Shahrukh Khan fired at the brother of the informant. Learned counsel submits that there is no

Patna High Court Cr.Misc. No.37355 of 2018 (2) dt.28-06-2018 allegation of committing any overt act against this petitioner rather this petitioner is said to be one of the persons who had accompanied the injured in course of marketing. Learned APP for the State is present.

Considering the facts and circumstances of the case whereunder there is no allegation of assault has been made against this petitioner and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of Smt. Madhavi Singh, learned Judicial Magistrate, Patna in connection with Kankarbagh P.S. Case No. 163 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
