The petitioner apprehends his arrest in connection with Chandan (Anandpur) P.S. Case no. 124 of 2019, registered under Sections 328 and 302/34 of the Indian Penal Code. The accusation is that in the matrimonial house of Bindu Devi, sister of the informant Kamal Yadav, dispute occurred in which Naren Yadav and Balkishore Yadav, both sons of Nathi Yadav (petitioner) and Ranju Devi killer her sister by administering poison.

Learned counsel for the petitioner submits that, admittedly, the petitioner is the father-in-law of the deceased Bindu Devi, wife of Bal Kishore Yadav and due to quarrel in between Bal Kishore Yadav, husband of deceased, and Naren

No.72288 of 2019(2) dt.18-11-2019 2/2 Yadav, another son of petitioner, petitioner Nathi Yadav decided partition of land between them and in that course the paper which was taken by the husband of the deceased vacant land was shown in her favour, whereas, residential house and some other land was come in the share of Naren Yadav, another son of petitioner, due to that reasons, Bindu Devi, wife of Balkishore Yadav committed suicide by consuming poison, but the petitioner, who is father-in-law of the deceased has falsely been implicated in this case. Moreover, Bal Kishore Yadav, husband of deceased is in custody. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Chandan (Anandpur) P.S. Case No. 124 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
