This application for grant of regular bail arises out of Sangrampur (Tetia Bambar) P.S. Case No.262 of 2023 registered for the offence punishable under Section 366(A) of the Indian Penal Code.

The petitioner is accused of kidnapping the victim girl.

Learned counsel for the petitioner submits that the victim girl had eloped with the petitioner on her own, which is apparent from the statement of the victim girl recorded under Sections 161 and 164 of the Cr.P.C.

Learned counsel for the State and learned counsel for the informant have opposed the prayer for bail by

Patna High Court CR. MISC. No.84009 of 2023(2) dt.10-01-2024 2/2 submitting that the victim girl is a minor.

The petitioner is in custody since 25.09.2023 and he has clean antecedent.

Considering the statement of the victim girl recorded under Sections 161 and 164 of the Cr.P.C., this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Munger, in connection with Sangrampur (Tetia Bambar) P.S.
