2. The petitioners seek bail in a case registered for the offence punishable under Sections 364, 120(B), 302, 201 of the Indian Penal Code.
3. The prosecution case, in brief, is that informant's son, namely, Sajan Kumar was kidnapped by local accused persons. He was beaten to death and his dead body was found near Chamantol Bahiyar on the next day. Informant suspected that the petitioners and other accused persons murdered his son.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.85196 of 2024(2) dt.05-02-2025 2/3 no such occurrence as alleged ever took place. They are quite innocent and have been falsely implicated in this case. He submits that there is no eye-witness to the present case, only on the basis of suspicion the petitioners have been made accused in the present case. Similarly situated co-accused have been enlarged on anticipatory bail by this Court vide order dated 05.03.2024 passed in Cr. Misc. No.68509 of 2023 and vide order dated 07.03.2024 passed in Cr. Misc. No. 83567 of 2023. The petitioners have no criminal antecedent and have been languishing in custody since 24.07.2024.
5. Learned APP for the State opposed the bail petition.
6. Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Sahebpur Kamal P.S. Case No.102 of 2023, subject to the further condition that petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on their absence on two consecutive
Patna High Court CR. MISC. No.85196 of 2024(2) dt.05-02-2025 3/3 dates without sufficient reason, their bail bond shall be cancelled by the learned Trial Court.
