The petitioner seeks bail in Jandaha P.S. case No. 11 of 2018 registered under Section 380 of the IPC. The informant alleged that on 24.01.2018 a theft was committed in his house and after breaking the Almirah Rs. 90,000/- cash and some ornaments were stolen away. The informant alleged that in the morning the petitioner was seen around the house of the informant and the petitioner earlier also committed theft in his house.

The learned counsel for the petitioner submits that on suspicion the name of the petitioner is mentioned in the FIR. Save and except suspicion there is no material to show the involvement of the petitioner. No stolen article was recovered

Patna High Court CR. MISC. No.72381 of 2019(3) dt.11-12-2019 2/2 from the possession of the petitioner and the petitioner is in jail since 06.04.2018. The petitioner has already remained in jail for one year and eight months.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner has already remained in jail for more than one year and eight months, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateXI, Vaishali at Hajipur in connection with Jandaha P.S. case No. 11 of 2018.
