Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 366A and 34 of the Indian Penal Code.

Informant in his written complaint has alleged that his minor daughter Ankita Kumar aged about 16 years went to coaching institute on 16.04.2019 but thereafter did not return and she subsequently came to know that petitioner has enticed her away for the purpose of marriage.

Statement of the victim girl was recorded under Section 164 of the Cr.P.C in which she stated that she had accompanied the petitioner on her own volition and she was not taken forcibly. She has further stated that petitioner did not tease or misbehaved with her. Petitioner has got no criminal antecedent.

No.76007 of 2019(3) dt.12-12-2019 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Brahmpura P.S. Case No. 112 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
