Mr. Anil Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks regular bail in connection with Raniganj P. S. Case No. 296 of 2018 registered for the offence punishable under Section 395 of IPC.

As per prosecution case, the house of the petitioner was looted by some miscreants taking away Rs. 3,43,649/-, two HHD Machine, a bag containing documents and a mobile phone. The F.I.R. is against unknown persons. Later on, name of the petitioner transpires on the confessional statement of the coaccused. It further appears that he is accused in one more case also of preparation of the dacoity.

Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is nothing against the petitioner. He is in custody for more than five months and in spite of that, he has not been put on TIP.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Araria, in connection with Raniganj P. S. Case No. 296 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
