ANJANA MISHRA ORAL ORDER 16-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner has been remanded in connection with the present case, i.e. Sessions Trial No.216/2018, arising out of Mirganj P.S. Case No.211 of 2017, on 16.04.2018, registered for the offence under Sections 394 and 307 of the Indian Penal Code read with Section 27 of the Arms Act, though he had been taken into custody on 11.12.2017 in connection with Mirganj P.S. Case No.214 of 2017.

Learned counsel for the petitioner submits that on the basis of the confessional statement made before the police by one Anurag Singh, the petitioner is remanded in connection with the present case and has since been languishing in jail. It is

No.36646 of 2018 (2) dt.16-07-2018 2/3 further submitted that the said Anurag Singh had indulged in some unruly behaviour with the petitioner, which was objected to by the present petitioner and as a consequence thereof, the petitioner has been named in connection with the present case. Having heard learned counsel for the petitioner and the learned counsel appearing for the State and in view of the fact that the name of the petitioner has surfaced on the confessional statement made before the police by the coaccused, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II, Gopalganj, in connection with Sessions Trial No.216/2018, arising out of Mirganj P.S. Case No.211 of 2017, subject to the following conditions :

(1) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.

(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons, his
