2. The petitioner has prayed for bail in connection with Katihar Town P.S. Case No. 724 of 2025 registered for the offence punishable under Sections 64, 61(2) and 3(5) of B.N.S. and Sections 67 and 67(A) of I.T. Act.

The case of the prosecution, in short, is that while the daughter of the informant was doing course of GNM at Katihar, this petitioner established relationship with her and on the promise of arranging job for her, has established physical relationship with her and has also made video of the alleged act and on the basis of the video, he was blackmailing the daughter of the informant and was demanding Rs. 5 lakhs.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

Learned counsel for the petitioner has submitted that during course of investigation, the victim has given her statement under Section 183 of the B.N.S.S. wherein she has stated that the petitioner was neighbour where she was residing or doing her nursing course. They developed friendship and it is alleged that the petitioner used to come at her room and there he has established forceful physical relationship with her and has also made video of the act and has blackmailed her on the basis of the video. It is further alleged that he has taken altogether Rs. 5 lakhs from the victim.

It has further been submitted that from perusal of the diary specifically para '28' it will transpire that the victim has denied for her medical examination. It has also been submitted that the allegation against the petitioner is that he has established forceful physical relationship with the victim of this case but as the victim has denied medical examination, it goes to show that the allegations are baseless otherwise she would have presented herself for medical examination to board. It has further been submitted that in the F.I.R., it is stated that the petitioner demanded Rs. 5 lakhs otherwise threatened to made viral the video whereas in the statement of the victim under Section 183 of the B.N.S.S., the victim has stated that he has already taken Rs. 5 lakhs from her.

No.80214 of 2025(3) dt.20-02-2026 3/3 independent witnesses have stated that there was relationship between the petitioner and the victim and there was hot talk between them due to that relationship. In this case, though the victim of this case has stated that she was subjected to forceful physical intercourse by the petitioner but contrary to this she has denied medical examination. Both these conducts are contrary. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 28.07.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No.724 of 2025.
