JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Raghunathpur Police Staton Case No. 153 of 2017 for the offences registered under Sections 272, 273, 308 of I.P.C. & 30, 38, 41 of Bihar Prohibition Excise Act 2016.
Learned counsel for the petitioner submits that in the instant case the liquor was allegedly seized from the open field and not from the conscious possession of the petitioner. He also submits that petitioner has no criminal antecedent and similarly circumstanced other co-accused have been granted bail on different benches of this Court.
Considering the aforesaid, let the petitioner, named above is directed to be released on bail on furnishing bail bond of Rs.10000/- (Rupees ten thousand) with two sureties of the
