2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 310(2) of the B.N.S.
3. The case of the prosecution, in short, is that, on 07.12.2024, the informant along with his companion, was returning home after attending a marriage ceremony. In the meantime, 5-6 unknown miscreants intercepted him near the village- Jitan Chhapra and looted away one mobile phone and cash. The FIR was lodged against unknown miscreants.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the petitioner is not
Patna High Court CR. MISC. No.80834 of 2025(2) dt.03-12-2025 2/3 named in the FIR and his name has surfaced in the confessional statement of Sunny Kumar. It has further been submitted that nothing has been recovered from the conscious possession of the petitioner and except the confessional statement there is nothing on record against this petitioner. It has also been submitted that the co-accused, on whose confession, the name of the petitioner has surfaced in this case, has already been granted bail by a Co-ordinate Bench of this Court vide order dated 04.08.2025 passed in Cr. Misc. No. 47759 of 2025. Moreover, the petitioner is languishing in judicial custody since 06.08.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of nine cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rani Talab P.S. Case No. 453 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Danapur, Patna/concerned trial Court.
