====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 06-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 1.4.2018, seeks bail in Kadamkuan PS Case No. 179 of 2018 registered under Sections 25(1-b)a, 26, 35 of the Arms Act and Section 11 of the Public Gambling Act.

The allegation in brief is that the police raided a place suspecting gambling was going on there, found some persons engaged in playing cards and it is alleged that the petitioner had secretly kept loaded country made pistol in his thigh. Learned Counsel for the petitioner submits that the persons apprehended there were playing cards and not engaged in gambling, only some personal money of the individuals were recovered and the petitioner was implicated in this case under the Arms Act and he has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Rahul Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VII, Patna in connection with Kadamkuan PS Case No. 179 of 2018.
