Petitioner seeks bail in connection with Baniyapur P.S. Case No. 314 of 2017 registered for the offence punishable under sections 392 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner is quite innocent and falsely been implicated in this case. Petitioner is not named in the F.I.R. He further submits that looted motorcycle was recovered from the open campus of the house of the petitioner. Petitioner is in custody since 01.12.2017.
Learned counsel for the State opposed the prayer for bail and submits that looted motorcycle was recovered from the house of the petitioner. Petitioner has confessed himself that he had participated in the crime. Petitioner has criminal history.
Patna High Court Cr.Misc. No.39624 of 2018(3) dt.08-08-2018 2/2 Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.
