2. The petitioner apprehends his arrest in connection with Konch P.S. Case No. 107 of 2023 registered for the offence punishable under Sections-341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

3. Allegedly, the petitioner assaulted the informant with iron rod on his head, due to which, he sustained head injury. Co-accused Ramadhar Manjhi having been armed with sword, is said to have assaulted Arvind Kumar on his head due to which, he also received head injury.

4. It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.84446 of 2023(3) dt.07-03-2024 2/2 that the specific allegation against the petitioner is that he assaulted Chhotu Kumar with iron rod on his head. Learned counsel for the petitioner has further submitted that the petitioner is innocent and has falsely been implicated in the present case. He is a person of clean antecedent and the injury on the person of Chhotu Kumar has been found to be simple in nature caused by hard and blunt object.

5. On the other hand, Sri J. N. Thakur, learned APP appearing for the State opposed the prayer for grant of anticipatory bail.

6. Considering the above-mentioned facts and circumstances of the case, let the petitioner named above, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateVIII, Gaya in connection with Konch P.S. Case No. 107 of 2023 subject to the conditions as laid down under Section 438 of the Cr.P.C.
