2. Petitioner seeks regular bail in connection with Ariyari P. S. Case No. 308 of 2023 in a case registered for the offence punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code.
3. As per FIR, informant suspects that FIR named accused persons including this petitioner, with whom he had long standing land dispute, killed the brother of the informant.
4. Learned counsel for the petitioner submits that from the FIR it is apparent that informant is not an eye witness to the occurrence. Only suspicion has been raised against this petitioner and others on account of long standing land dispute. During course of investigation, no material has come to suggest the active participation of the petitioner in the alleged

Similarly situated other co-accused Amrik Chauhan has been granted the privilege of anticipatory bail by this Court vide order dated 14.05.2024 passed in Cr. Misc. No. 28075 of 2024, co-accused Arvind Kumar @ Arbind Chauhan has been granted regular bail by a co-ordinate Bench of this Court vide order dated 10.05.2024 passed in Cr. Misc. No. 17092 of 2024 and co-accused Sajjan Kumar @ Sajan Kumar has also been granted regular bail by a co-ordinate Bench of this Court vide order dated 10.05.2024 passed in Cr. Misc. No. 26262 of 2024. Petitioner claims clean antecedent and he is in custody since 02.08.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate1st, Sheikhpura in connection with Ariyari P. S. Case No. 308 of 2023.
