The petitioner is languishing in custody in connection with Excise Complaint Case No. C-2 173/2019 for the offence punishable under Section 30(a) of the Bihar Excise and Prohibition Act, 2016.

Allegation is regarding recovery of 24.510 litres of illicit country made liquor from possession of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent.

Learned counsel for the petitioner submits that the petitioner is in custody since 06.10.2019.

Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.75921 of 2019(2) dt.29-11-2019 2/2 above named, be released on bail after completion of investigation on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Excise Complaint C-II Case No. 173 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court below; and (b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
