2. The petitioner seeks bail in connection with GR No. 82/22 NDPS Case Reg. No. 43/2023 arising out of Sonbara P.S. Case No. 461/2022 registered for the offences punishable under Sections 8, 20(b)(ii)(C )and 25 of the N.D.P.S. Act.

3. As per the prosecution case, 105 kgs of Ganja were recovered from the accused persons.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Learned counsel further submits that name of the petitioner has come in the confessional statement of co-accused and no incriminating article has been recovered from his possession. Learned counsel further submits that out of seven witnesses six

Petitioner is a man with a clean antecedent and he is in custody since 04.03.2023. The petitioner undertakes to co-operate in the case/ trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II -cum - Special Judge (NDPS) Act, Sitamarhi /concerned Court below in connection with GR No. 82/22 NDPS Case Reg. No. 43/2023 arising out of Sonbara P.S. Case No. 461/2022 subject to the following conditions:- (i) The petitioner after being released on bail, is directed to mark his attendance at Sonbarsa Police Station, District- Sitamarhi on every Sunday of the month. Any default in appearance at the Police Station will result in cancellation of bail bonds of the petitioner. (ii) the petitioner after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the Trial Court on each and every date fixed by the trial Court.
