The petitioner seeks bail in a case registered under Sections 376, 506 of the Indian Penal Code and Section-4 of the POCSO Act as well as Section 67(A) of the I.T. Act. Prosecution case in short is that the petitioner being Director of SBI customer service centre, used to call at the informant in the centre and in the name of giving training, continued to establish physical relation at different places with the informant. It is also alleged that obscene photo was captured and when the informant refused to oblige him, he threatened to viral the obscene photo.

It has been submitted on behalf of the petitioner that the

Patna High Court CR. MISC. No.74716 of 2019(4) dt.05-03-2020 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 02-08-2019. Charge sheet has already been submitted. The victim has already been examined in course of trial and she has retracted from her earlier statement.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist-cum-Special Judge, POCSO Act, Kaimur at Bhabua in connection with Mahila (Bhabua) P.S. Case No. 04 of 2019.
