2. The petitioners apprehend their arrest in connection with Yogapatti P.S. Case No. 206 of 2024 for the offence registered under sections 306/201/120B/34 of the IPC lodged on 17.06.2024 by the informant Ramesh Yadav.
3. As per the prosecution story, the informant alleged that he got information about a lady having committed suicide after quarrel with the in-laws and the dead body has been disappeared by the accused persons. To verify the same, the Police Officer reached the place but could not find the dead body. Later, in an asbestos house, the body was recovered. This led to the FIR. Subsequently, during investigation, it was disclosed that due to
Patna High Court CR. MISC. No.87870 of 2024(3) dt.18-03-2025 2/2 torture by the family in-laws, information has come that the suicide took place and the accused persons wanted under conspiracy to drop the dead body in the Gandak river.
4. Learned counsel for the petitioners submit that it is a case of suicide, they have no role to play and will abide by terms and conditions if granted relief.
5. Learned APP, Mr. Jitendra Kumar Singh submits that it is a case of anticipatory bail, the police upon information, went to the place. It is not a case of simple suicide, the body was also disappeared and after much effort, the police was able to retrieve the dead body. In that background, they do not deserve anticipatory bail.
6. Taking into account the aforesaid facts and circumstances and the conduct of the accused persons, even if it is assumed for the present that she committed suicide, they tried to disappear the body and it was due to the effort of the police that the same could be recovered, in that background, they do not deserve anticipatory bail.
