JUSTICE PURNENDU SINGH ORAL ORDER 09-04-2024 Heard Mr. Raja Ram Mishra, learned counsel appearing on behalf of the petitioner; Mr. Nalin Vilochan Tiwary, learned counsel for O.P.no.2 and Mr. Mithilesh Kumar Khare, learned APP for the State.

2. Petitioner seeks pre-arrest bail in connection with Complaint Case No.30273 of 2014 registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code.

3. Mr. Nalin Vilochan Tiwary, learned counsel for O.P.No.2 informs that the parties have agreed to resolve their dispute, relating to the money matter, amicably by way of mediation.

4. Considering the aforesaid information, the

Patna High Court CR. MISC. No.82546 of 2023(4) dt.09-04-2024 2/2 petitioner may discharge his liability on the agreed terms. At the same time, he will also withdraw the similar nature of cases lodged by him against the informant. In this regard, specific statement has been made in paragraph no.5 of the bail application.

5. Having considered the aforesaid information, the petitioner is directed to be released on provisional bail subject to conditions as laid down under Section 438(2) of the Cr.P.C. and the learned district court deems fit and proper in connection with Complaint Case No.30273 of 2014 pending before the court learned J.M. 1st Class, Patna/concerned court.

6. The petitioner and the O.P.no.2 are directed to file their respective affidavit in respect of the terms and conditions agreed between them before the district court within a period of six weeks from the date of order of this Court.

7. Once such affidavit is filed, the provisional bail granted to the petitioner shall be made absolute on such terms and conditions.
