The petitioner seeks regular bail in S.Tr.No.76/17 /14 of 2017 arising out of Jehanabad P.S.Case No.296 of 2016 registered for the offence under Sections365, 302, 201, 120(B), 467, 468 and 471 of the I.P.C.
Learned counsel appearing for the petitioner submits that the prayer for bail of the petitioner is refused thrice by this Court lastly on 13.12.2017 vide Cr.Misc. No.35294 of 2017. He further submits that the petitioner was not named in the F.I.R. but in course of investigation the police got recorded the confessional statement of petitioner wherein the petitioner disclosed that on the request of Sangal Swami, he provided one room in his house in which victim was kept and thereafter injecting poison he was murdered and his dead body was disposed of. Further
Patna High Court Cr.Misc. No.39012 of 2018 (2) dt.11-07-2018 2/2 submission is that co-accused, Sangal Swami @ Binay Kumar has been extended the privilege of bail vide order dated 02.05.2018 passed in Cr.Misc.No.26304/18. Petitioner is in custody since 21.07.2016 having no criminal antecedent.
Having considered the facts and circumstances of the case and the period of incarceration, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1st , Jehanabad, in S.Tr.No.76 of 2017 / 14 of 2017.
