2. The petitioner has preferred this application for grant of regular bail in connection with Raushanganj P.S. Case No. 67 of 2024 dated 21.05.2024 registered for the offences punishable under Section 366A of the Indian Penal Code and under Sections 8 and 12 of POCSO Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have kidnapped the minor daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the

Patna High Court CR. MISC. No.85338 of 2024(2) dt.18-01-2025 2/2 petitioner. It is further submitted that the victim has solemnized marriage with the petitioner. The victim in her statement recorded under Section 164 of the Cr.P.C. has stated that the petitioner has established physical relationship with her consent. The victim is minor aged about 15 years. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 4 of the bail petition. The petitioner is in custody since 27.05.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court of Exclusive Special Judge POCSO-cum-Additional Session Judge, VII, Gaya in connection with Raushanganj P.S. Case No. 67 of 2024.

7. The application stands allowed.
