2. The petitioner seeks bail in connection with Gwalpara P.S.Case No. 83 of 2021 registered for the offence punishable under Sections 394 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner along with other accused persons has looted a motorcycle and Rs. 16,000/- from the informant.
4. The petitioner has five criminal antecedents and he is in custody since 31.03.2023.
5. Learned counsel for the petitioner has submitted that petitioner is ready to stay outside the State during pendency of the trial of the cases which are pending against him.
6. Considering the period of custody, this application is allowed, let the above named, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.85632 of 2023(7) dt.09-08-2024 2/2 satisfaction of the learned Judicial Magistrate 1st class, Udakishunganj, Madhepura in Gwalpara P.S.Case No. 83 of 2021.
7. This is subject to the condition that the petitioner will reside with his relatives at Yamuna Nagar, Harayana and will mark his attendance in Jagadhari Police Station, Yamuna Nagar, Harayana on 1st Sunday of each month. If the petitioner has to come to Bihar for attending the hearing of the cases pending against him then he will inform the Jagdhari Police Station about his visit. Any default to make attendence in the concerned Police Station will lead to cancellation of the bail bonds of the petitioner.
8. The Court below, if possible, will allow the petitioner to appear virtually on the date fixed in the trial so that the petitioner is not made to travel to Bihar From Harayana on each and every date.
9. Let a copy of this order be communicated to the Superintendent of Police, Yamuna Nagar, Haryana forthwith through FAX for its compliance.
