2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 30 (a) , 36 of Bihar Prohibition and Excise (Amendment) Act 2022 . 3 . It is alleged that 40 liters of spirit has been recovered from two motorcycles and two accused were apprehended on the spot and this petitioner succeeded in fleeing away from the spot.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of confessional statement of other co-accused persons. Petitioner is neither owner nor driver of the vehicles in question . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the

6. Considering the facts of the case, in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Exclusive Special Excise court No. V Gaya in connection with Amas Police Station Case No. 297 of 2024 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
