2. A prayer for bail has been made on behalf of the petitioner in connection with Siswan P.S. Case no.232 of 2024 registered under sections 137(2), 87 and 3(5) of BNS, 2023.

3. Allegation in the F.I.R is that petitioner kidnapped the informant's wife.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the case. Further, F.I.R was lodged after a delay of 6 days, for which no explanation has been tendered. It is an admitted fact that both the petitioner and the informant are patidars having old enmity between them. It has further been submitted that after recovery of the victim, her statement was recorded wherein she has stated that her age is

Patna High Court CR. MISC. No.79951 of 2025(3) dt.19-02-2026 2/2 around 30 years and has even accepted that she had some illicit relation with the petitioner. The petitioner is in custody since 20.07.2025 and has no criminal antecedent. He undertakes to cooperate in the case/trial.

5. The application for bail is opposed by learned A.P.P. for the State.

6. Taking into consideration the aforesaid facts and circumstances of the case and also considering that both the petitioner and the victim are patidars and the statement of the victim reveals that she had illicit relation with the petitioner, the petitioner is directed to be enlarged on bail in connection with Siswan P.S. Case no.232 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/successor Court.
