2. The petitioners have prayed for bail in connection with Siwan Mufassil P.S. Case No. 263 of 2024 registered for the offence punishable under Section 394 of the Indian Penal Code.

3. The case of the prosecution is that the brother of the informant has gone to Jeeradei for some work. While he was returning, near Bhantapokhar Railway Bridge, unknown miscreants intercepted him, assaulted him with knife and also snatched his bike and cash.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have

Patna High Court CR. MISC. No.82147 of 2024(4) dt.17-03-2025 2/2 committed no offence. They have been falsely implicated in this case. The F.I.R. was lodged against unknown miscreants. On suspicion, the petitioners were apprehended. Petitioner no.2 has also given his confessional statement. It is submitted by learned counsel for the petitioners that nothing has been recovered from the possession of these petitioners and there is nothing except the confessional statement against them. It has also been submitted that no T.I.P. was conducted. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Petitioners are languishing in judicial custody since 15.05.2024.

5. The application for bail is opposed by learned APP for the State and learned counsel for the informant.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Siwan Mufassil P.S. Case No.263 of 2024.
