2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 307, 379, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR, on 21.07.2023, in the evening the petitioner called husband of the informant and on this call her husband, namely, Ashutosh Sahi departed from his house by a Scorpio with three personal bodyguards and driver, in the same night she got information that her husband has been killed in the house of co-accused Quasim Hassan @ Dollar

Patna High Court CR. MISC. No.79072 of 2023(4) dt.19-01-2024 2/3 along with his three bodyguards by the accused persons. Thereafter, personal guards were taken to hospital but they also died during course of the treatment.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case merely on the basis of suspicion and previous dispute. The informant is not an eye witness of the alleged occurrence and the petitioner is not apprehended on the spot. During investigation, it came into light that the petitioner merely played a role of liner and there is no specific allegation of murder attributed against him. The specific allegation of murder is against three co-accused persons namely, Mantu, Ranjay and Govind who were seen by the witnesses at the place of occurrence, but they have not stated about the complicity of the petitioner in this alleged occurrence. Moreover, the petitioner is languishing in judicial custody since 24.07.2023.

5. Learned APP appearing for the State has vehemently opposed the prayer of Bail and submitted that the petitioner in connivance with other committed murder of the informant's husband due to previous dispute.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Muzaffarpur Town P.S. Case No. 614 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur.
