2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 25(1-B)(a), 26, 35 of the Arms Act.

3. The case of the prosecution is that one pistol and altogether 25 live cartridges were recovered from the possession of this petitioner.

4. Learned counsel for the petitioner has submitted that from perusal of the seizure list it transpires that the witnesses of seizure list are not the independent witnesses. It is further submitted that nothing has been recovered from the possession of the petitioner. From perusal of the bail petition it transpires that the petitioner is having criminal antecedent of 17

Patna High Court CR. MISC. No.83053 of 2024(3) dt.17-03-2025 2/2 cases and the learned counsel for the petitioner submitted that the petitioner is on bail in all those cases. The petitioner is in custody since 29.07.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the above facts and circumstances, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the court of learned A.C.J.M.- I, sherghati, Gaya in connection with Sherghati P.S. Case No. 384 of 2024.

7. Accordingly, the present bail application stands allowed.
